General Terms and Conditions of Use (T&Cs)



I. General

Grand Casino Kursaal Bern AG operates the online casino 7 Melons via and other access options (e.g. apps) under the name 7 Melons (hereinafter each individually and collectively referred to as the "Website"). All rights in connection with 7 Melons apply exclusively to Grand Casino Kursaal Bern AG, Kornhausstrasse 3, 3000 Bern, Switzerland (hereinafter "7 Melons"). The Grand Casino Kursaal Bern AG is supervised by the Swviss Federal Gaming Commission ( and holds the Swiss licence no. 516-005/03, as well as the licence extension to include the right to conduct casino games online no. 516-005/03-01.

These General Terms and Conditions and Conditions of Use ("T&Cs") or their acceptance are a prerequisite for the use of the Website. The T&Cs will become effective immediately upon initialization of the registration on the Website. Upon registering a player account with 7 Melons, you agree to have understood and fully accept our T&Cs. By using our website or any of our games, you fully acknowledge and agree to accept our T&Cs throughout your use of our website.

These Terms and Conditions do not cover any issues arising from the use of the Websites and the Games with third party hardware (e.g. PC, mobile phones, tablets) or software (e.g. operating system, web browser, access software), the use of third party app stores (e.g. Google Play, iTunes, Windows Store, Apple Store) or the User's internet connection to the Services, as these services are not provided by 7 Melons.

To open a player account at 7 Melons, you must i) be of legal age, ii) have a domicile or habitual residence in Switzerland, iii) not be subject to any gambling ban (art. 80 BGS) and iv) not be subject to any gambling ban (art. 52 BGS).

If a person has registered with 7 Melons who is not of age, does not have a domicile or habitual residence in Switzerland, is subject to a gambling ban or is subject to a gambling ban, losses will not be reimbursed and winnings will not be paid out, taking into account Art. 52 (4) of the Ordinance on Gambling.

You may only have one (1) Player Account on our Website. If you attempt to open more than one Player Account, all Player Accounts may be suspended by us and any bonuses may be cancelled. It is prohibited to sell, transfer, usufruct or purchase Player Accounts to or from any other person, or to use Player Accounts belonging to any other person.

You may use our website and your customer account solely for the purpose of participating in games of chance for recreational and leisure purposes and not for any commercial, professional or other reasons.

By using the Website, you confirm that you will not act fraudulently, collude with other players, engage in any other illegal activity or engage in any activity with any third party and that you will not manipulate our games by any hardware or software based methods.

You agree not to ­distribute any content (e.g. images, videos, links, words) in connection with the website and other offers of 7 Melons that contains advertising, political, religious, offensive, harassing, threatening, violent, sexist, pornographic or other morally reprehensible, indecent or objectionable, in particular racist, right-wing or ­left-wing extremist content, persons or images.

7 Melons reserves the right to retain any personal data provided by you for as long as permitted or required by law. You have the right to access the personal data we hold about you.

7 Melons reserves the right to change the offer at any time.

II. Registration of a player account

In order to participate in real money games at 7 Melons, a registration ("Player Account") via the website www. is required. 7 Melons reserves the right to refuse to open a customer account without giving reasons.

You must fill in all the required mandatory information in our registration form truthfully and according to an official ID, in particular your first name, last name, date of birth, nationality, gender, domicile or residence address as well as a valid e-mail address and mobile phone number. By completing the registration, you confirm that all the information provided is true.

As part of the registration process, you must select a username and password for your subsequent login to the website. The user name should not allow any conclusions to be drawn about your identity, as this is public and therefore also visible to third parties. It is your sole responsibility to keep your login details secure and not to disclose them to any third party. 7 Melons is not responsible for any misuse of your access data by third parties and the resulting consequences, should third parties gain access to your data. Furthermore, 7 Melons reserves the right to block your account and to withhold existing credit balances in the event that your customer account is used by a third party or if there is any suspicion of such use. Before completing registration, a maximum value in Swiss francs for the daily net loss must be defined by you. The defined maximum value can be changed in the player account at any time, whereby a decrease takes effect immediately and an increase only after 24 hours.

For the duration of this agreement and the business relationship with us, you undertake to provide only complete and truthful information regarding your person and to inform us immediately of any changes to such data. In the event that any changes occur as a result of which you are no longer entitled to play at Swiss online casinos and these are not reported in a timely manner, losses cannot be reimbursed and winnings cannot be paid out, taking into account Art. 52 No. 4 of the Ordinance on Money Games.

When you register, your specified address of residence or domicile is compared. For this purpose, we transmit the personal data required for this purpose (first name, surname and address data) to an information centre (CRIF AG, Riesbachstrasse 61, 8008 Zurich). A check will also be made to ensure that you are not listed in the register of banned players. You expressly agree to these procedures.

III. Provisional opening of a player account

After registration, a provisional player account is opened. For a final opening, you must submit a copy of an official ID and, if the domicile or residence address could not be verified via the information centre, a corresponding address confirmation (copy of an electricity, TV or internet bill or a bank statement) within 30 days. As long as the player account has not been definitively opened, your transfers may not exceed CHF 1`000 cumulatively and your winnings may not be paid out, in accordance with Art. 52 of the Ordinance on Money Games. If the necessary documents for the verification of the information provided have not been submitted within 30 days, is obliged, in accordance with Art. 52 of the Ordinance on Money Games, to set the player account inactive.

IV. Deposits to your player account

In case of approval and authorization, the deposit amount will be credited to your customer account. If the card issuer does not approve or authorize the deposit, your customer account will not be credited. Balances on your customer account do not earn interest. 7 Melons does not grant credits and does not grant the possibility of overdrawing the customer account.

V. Payouts

Pursuant to Art. 50 of the Ordinance on Money Games, payouts may only be transferred to a payment account that is in your name. 7 Melons may request identification documents or other information during a payout transaction.

VI. Inactive player account

A player account is considered inactive if it has not been used for 6 consecutive months. 7 Melons will contact you if your account becomes inactive.

After 24 months, 7 Melons will independently transfer the remaining amount (excluding any bonus credit) to a payment account recorded in the player account. If this is not possible due to missing or invalid account details and if 7 Melons is unable to contact you, 7 Melons is obliged to transfer the remaining balance to the AHV compensation fund after a further 24 months (Art. 51 of the Ordinance on Money Games). Any claims against 7 Melons are thereby forfeited in full.

VIII. Responsible gaming

At 7 Melons, our focus is on providing a positive and enjoyable gaming experience. On our website, we provide various tools to control or limit one's gaming behavior.

We are required by law to issue a gambling ban if there is any suspicion that someone is overindebted, is not meeting financial obligations or is risking stakes that are disproportionate to their income and assets. The gambling ban applies to the whole of Switzerland. You can obtain information about the data stored about you from CRIF AG at any time.

IX. Fighting money laundering

7 Melons may block your customer account and withhold your existing credit balance as soon as there is a suspicion of money laundering. In the case of certain transactions, we are obliged to request further information from you in accordance with the Ordinance of the Swiss Federal Gaming Board on the Due Diligence Obligations of Casinos to Combat Money Laundering and Terrorist Financing. Until the legally required information and documents are provided, the player account may remain blocked.

X. Bonus rules

Bonus credits (bonuses) are amounts of money that can be credited to a player's account in connection with promotions (e.g. when registering or depositing funds). The conditions for granting, using or redeeming bonuses are defined in these bonus rules. However, there are bonuses whose rules are described on the Website at the time they are granted or in the context of certain games.

Bonuses are used as wagers on the games offered on the site. Before claiming the bonus balance, real money is automatically played with existing stakes. If you have a bonus balance, any winnings above the real money balance at the start of the gaming session will automatically be converted into bonuses.

The bonuses are converted into real money when the relevant turnover condition (playthrough) is met. The turnover condition indicates how much real money must be wagered in order to convert the bonus money into real money. You can see the current turnover requirement for each bonus in your account. XI. General gaming rules

A game can only be started if you are registered at 7 Melons and your player account is sufficiently funded. Game instructions are available in the individual games. If the connection is interrupted during an ongoing game, the game is recorded on the game servers. The result is displayed in the status of the player account and any winnings are credited to the player account. After a game interruption, no new game is initiated and no further bet is debited.

In the event of a software error or malfunction of the random number generator (RNG), the current game is void.

If 7 Melons has mistakenly credited an incorrect amount to your Player Account, you must notify us immediately and reimburse us for the incorrect credit.

You are solely responsible for any taxation of your winnings and compliance with other financial and legal requirements. For winnings in excess of CHF 1 million, we are obliged to withhold withholding tax and pay it to the Swiss Federal Tax Administration.

XII. Data protection

Data protection is important to 7 Melons: you should be able to rely on us to handle your data carefully and to respect data protection in every respect. To meet this expectation, 7 Melons is ISO 27001 certified (international standard for information security).

By using the website, you agree to receive information from 7 Melons. You can adjust your preference about how we communicate with you at any time in your account. Please note that from time to time we may need to send you some important communications (for example, in the event of account inactivity, extended identification requirements, communications relating to the social concept, anti-money laundering or changes to the T&Cs), from which you will not be able to opt out. The use of personal data is governed by the Privacy Policy. The Privacy Policy is an integral and binding part of these T&Cs.

XIII. Guarantee

7 Melons will perform the Services carefully and professionally within the limits of its operational resources and foreseeable requirements. You are aware that 7 Melons provides all services via the Internet or using communication networks. In particular, due to technical malfunctions, operational disturbances as well as disturbance or interruption of communication networks and due to a failure of IT infrastructures, telephone lines or other parts of the infrastructure used for the provision of services, temporary impairments or interruptions of the provision of services by 7 Melons may occur. 7 Melons therefore gives no guarantee for the uninterrupted availability and faultlessness of its services.

7 Melons secures the systems against virus infestation. However, a virus attack can never be completely excluded. In addition, it can happen that unauthorized third parties send ­emails using the name of 7 Melons without its consent, which contain viruses or spyware, for example, or ­link to web content ­that contains viruses or spyware. This is beyond the control of 7 Melons. Accordingly, 7 Melons disclaims any liability in this context.

XIV. Liability

7 Melons is only liable for direct damages caused by gross negligence or intent and which lie within the area of responsibility of 7 Melons. Any further liability is - as far as legally permissible - excluded.

Liability is expressly excluded for slight negligence and for indirect or consequential damages. Consequential damages are in particular loss of profit, damage to reputation and loss of data as a result of temporary impairments or interruptions in the availability of the services of the website and as a result of transmission errors and incorrect price or service information. Also excluded is any liability of 7 Melons for the content of third parties that refer to the website or to which the website refers.

XV. Intellectual property

The website as well as the entire content accessible via it are protected by copyright and, unless otherwise specified, belong exclusively and comprehensively to 7 Melons. Contents may contain references to property rights and rights of use of third parties, which must be observed by the user. The (complete or partial) reproduction, distribution, transmission (electronically or by other means), modification, linking or use of the contents for public or commercial purposes is prohibited without the prior written consent of 7 Melons.

XVI. Edition / Changes

Our T&Cs are published in several languages for information purposes and for easier orientation. However, should there be any discrepancies between these T&Cs in other languages and the German version of our T&Cs, the German version shall always be binding for both contractual partners.

7 Melons reserves the right to make changes to these T&Cs at any time, thereby amending the agreement between you and 7 Melons. We will send you any changes to our T&Cs by email before they come into effect. If you do not accept changes, you may contact our customer support and request closure of your account at any time. Changes to our T&Cs will become effective immediately upon publication on www. It is your own responsibility to review our T&Cs and familiarize yourself with the specific rules of our games.

XVII. Transfer

7 Melons reserves the right to assign or otherwise lawfully transfer this Agreement. You may not assign or otherwise transfer this Agreement.

XVIII. Court of jurisdiction

The place of performance for all services provided by 7 Melons and the place of jurisdiction is Bern (Switzerland). The relationship between you and 7 Melons is governed exclusively by Swiss law. If individual clauses of the above provisions should be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
